Negotium-Solutions Product License Agreement and Warranty Terms Trademarks and Copyright Statement

1. Privacy PolicyData Collection
•     Only data explicitly shared by users is collected.
•     No hidden tracking or unauthorized collection occurs.


Data Storage
•     All data is stored in secure environments within the Negotium platform.
•     Each client operates within a ring‑fenced tenant environment, isolated from other clients.

 

Data Sharing
•     Personal and client data is never shared with third parties.
•     Strict privacy controls prohibit unauthorized disclosure.

 

Data Security
•     Data is encrypted in transit and at rest using industry‑standard protocols.
•     Access is restricted to authorized users only.

 

Data Usage
•     Data is used solely for reporting purposes within the client’s tenant environment.
•     No profiling, resale, or marketing use of client data.

 

Compliance
•     Negotium complies with applicable data protection laws, including POPIA (South Africa), GDPR (EU), and other relevant regulations.

 

2. Security Policy
•     Access Controls: Role‑based access and authentication protocols are enforced.
•     Monitoring: Regular audits and monitoring are conducted to identify vulnerabilities.
•     Incident Response: A formal procedure is in place to respond to and mitigate breaches.
•     Infrastructure Security: Hosting environments are hardened and regularly updated.

 

3. Data Retention & Deletion Policy
•     Data is retained only for the duration of the client’s active subscription.
•     Upon termination, all client data is exported and provided to the client.
•     Hosting servers for the client’s instance are securely cleared.
•     Clients may request permanent deletion of data at any time.

 

 

4. Cancellation & Refund Policy
•     Clients may cancel services with 30 days’ written notice.
•     No refunds are provided for unused subscription periods.
•     At termination, all client data is returned, and servers are securely cleared.

5. Terms of Service
Scope of Services
Negotium provides business optimization software, reporting tools, and related solutions.

Client Responsibilities
•     Ensure accurate and lawful data input.
•     Maintain compliance with applicable laws and regulations.

 

Company Responsibilities
•     Provide secure hosting, system uptime, and technical support.
•     Protect client data with strict privacy and security measures.

 

Limitation of Liability
Negotium is not liable for indirect, incidental, or consequential losses arising from use of the platform.
Governing Law
This agreement is governed by the laws of South Africa.
Dispute Resolution
Disputes will be resolved through arbitration in Gauteng, South Africa, unless otherwise agreed.

 

6. Support Policy
•     24/7 human support is available via email, phone, and ticketing system.
•     Response times are governed by service level agreements (SLAs).

 

7. Accessibility Statement
•     Negotium is committed to digital accessibility and compliance with WCAG standards.
•     All users, regardless of ability, should be able to access and use the platform.

 

8. License Agreement
•     Clients are granted a non‑exclusive, non‑transferable license to use Negotium software.
•     Clients may not resell, sublicense, or reverse engineer the software.
•     Intellectual property rights remain with Negotium Solutions.

 

9. Compliance & Ethics
•     Negotium prohibits fraudulent, abusive, or unlawful use of its services.
•     Clients must comply with all applicable laws and regulations.
•     Negotium reserves the right to suspend services in cases of abuse or non‑compliance.

 

10. Cookie Policy
•     If cookies are used, their purpose will be disclosed (e.g., session management, analytics).
•     Users will be informed and consent will be obtained where required.
